These terms are a legally binding agreement between you and NIROS SOFT SRL.

2) Acceptance of terms

By accessing or using MessAPI, you confirm that you have read and agree to these Terms. If you use MessAPI on behalf of a business, you represent that you have authority to bind that business.

3) Accounts & acceptable use

• You are responsible for keeping credentials confidential and for all activity under your account.
• Do not use MessAPI for illegal activities, spam, abuse, or infringement of third-party rights.
• We may suspend or terminate accounts that violate these Terms or threaten the security or integrity of the service.

4) Subscriptions, payments, and Merchant of Record

Paid plans are billed in advance for the selected term (monthly or annual) and renew automatically until cancelled.

MessAPI uses Gumroad.com as the Merchant of Record (MoR) for payments and invoicing. You will receive receipts/invoices from Gumroad.com. Where applicable, sales tax/VAT is calculated and remitted by Gumroad.com. Card/bank statements may show a descriptor configured for our store (often including “FS*”).

• Refunds are governed by our Refund Policy.
• By purchasing, you authorize recurring charges unless you cancel before the renewal date.

5) Trials, cancellation, and downgrades

• If a free trial is included, charges start automatically at the end of the trial unless you cancel.
• You can cancel at any time from your account settings; access continues until the end of the current paid term.
• Downgrades take effect at the next billing period.

6) Intellectual property

MessAPI (including software, UI, documentation, and content) is owned by NIROS SOFT SRL or its licensors. You receive a limited, revocable, non-exclusive license to use the service according to these Terms. You may not reverse engineer or circumvent technical protections.

7) Warranties & disclaimer

MessAPI is provided “as is”. To the extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.

8) Limitation of liability

To the fullest extent permitted by law, NIROS SOFT SRL will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, or business interruption. Our aggregate liability under these Terms will not exceed the amounts paid by you to us in the 12 months prior to the event giving rise to the claim.

9) Privacy & data protection

Your use of MessAPI is also governed by our Privacy Policy, which explains how we collect and process personal data. By using MessAPI you acknowledge that policy.

10) Governing law & venue

These Terms are governed by the laws of Romania. Courts having jurisdiction over our registered office shall have exclusive jurisdiction, unless mandatory consumer law provides otherwise.

11) Changes to these Terms

We may update these Terms from time to time. We will post the new version on this page with the effective date. Continued use of MessAPI after changes means you accept the updated Terms.
